1. Introduction & Acceptance

Welcome to ReleasKit. These Terms of Service ("Terms") govern your access to and use of our website, services, and AI-powered artwork generation platform (collectively, the "Service").

By creating an account or using our Service, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use our Service.

You must be at least 18 years old to use ReleasKit. If you are between 13 and 18 years old, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Service Description

ReleasKit is an AI-powered platform that helps independent musicians create artwork for their music releases. Our Service includes:

• AI-generated artwork creation based on your inputs and preferences
• Platform-specific asset generation (cover art, promotional materials)
• Artist profile management
• Image editing and outpainting capabilities
• Video generation for promotional content

We use third-party AI services including Google Gemini, Google Imagen, and fal.ai to power our generation features. Your use of these features is also subject to the terms of these providers.

3. Account Registration

To use ReleasKit, you'll need to create an account. You can sign up using:

• Email and password
• Google OAuth
• Spotify OAuth

You're responsible for maintaining the security of your account and password. ReleasKit cannot and will not be liable for any loss or damage from your failure to maintain account security.

You must provide accurate information when creating your account and keep your information up to date.

4. Token System & Payments

ReleasKit uses a token-based system for AI generations:

• Free tokens: New accounts receive 10 free tokens upon signup
• Token costs: Actions cost between 1-3 tokens depending on complexity
• Purchased tokens: Additional tokens can be purchased and do not expire

Refund Policy: Token purchases are generally non-refundable. However, if a generation fails due to a technical error on our end, the tokens will be automatically refunded to your account.

We reserve the right to modify token costs and pricing at any time. Any changes will be communicated to you in advance and will not affect tokens you've already purchased.

5. Intellectual Property Rights

Your Content

You retain full ownership of any images, text, or other content you upload to ReleasKit ("Your Content"). By uploading content, you grant us a limited license to process and store it solely to provide the Service.

AI-Generated Content

You own the rights to AI-generated artwork created through ReleasKit based on your inputs. You may use this content for commercial purposes, including album covers, promotional materials, and merchandise.

Important Limitations

• No exclusivity: AI systems may produce similar or identical outputs for different users. We do not guarantee that your generated artwork will be unique.
• Third-party terms: Your use of AI-generated content is also subject to the terms of our AI providers (Google, fal.ai). We recommend reviewing their policies.
• No warranty of clearance: We do not guarantee that generated content is free from third-party intellectual property claims. You're responsible for ensuring your use is lawful.

Our Content

The ReleasKit name, logo, website design, and other proprietary content remain our exclusive property and may not be used without our written permission.

6. Acceptable Use Policy

You agree not to use ReleasKit to create, upload, or generate:

• Content that infringes on any third party's intellectual property rights
• NSFW, explicit, or adult content
• Hate speech, discriminatory content, or content promoting violence
• Deepfakes or misleading content depicting real people without consent
• Content that violates any applicable laws or regulations
• Malware, spam, or malicious content

You also agree not to:

• Use automated systems (bots, scrapers) to access the Service
• Attempt to circumvent usage limits or token systems
• Reverse engineer, decompile, or attempt to extract our algorithms
• Share your account credentials or allow unauthorized access
• Interfere with or disrupt the Service's infrastructure

7. Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

• The quality, accuracy, or uniqueness of AI-generated content
• Uninterrupted or error-free operation of the Service
• That generated content will meet your specific requirements
• The preservation of your content in case of technical failures

AI technology is evolving rapidly. Results may vary and we continuously work to improve our Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RELEASEKIT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

9. Account Termination

You may delete your account at any time through your account settings. Upon deletion:

• Your account data will be removed within 30 days
• Any unused tokens will be forfeited
• Generated artworks may be retained for a limited period per our Privacy Policy

We may suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity. We'll notify you of any termination unless prohibited by law.

10. Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles.

For any disputes arising from these Terms or the Service, you agree to first attempt to resolve the matter informally by contacting us at support@releaskit.com.

If informal resolution fails, any legal action must be brought in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

11. Changes to Terms

We may update these Terms from time to time. We'll notify you of any material changes by email or through a notice on our Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

12. Miscellaneous

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ReleasKit.
• Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
• Assignment: You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.
